Initial considerations

It is the responsibility of the participant to know all aspects of the regulation.

With the registration, the participant accepts these rules and the conditions of participation

Participants should respect and care for the environment, avoiding any type of contamination.

Registration

The registration is personal and not transferable, since the fact of registering implies the acceptance of these regulations.

All the information requested in the enrolment process must be true. The organization is not responsible for the misrepresentations or errors that the participant states when registering.

Accept the discharge of responsibility and the declaration of physical aptitude that appears in the form of inscription.

Management of casualties. The organization makes available to the participant the possibility of contracting a cancellation insurance. If you do not hire this insurance, no refund will be made under any circumstances, including injuries, accidents, trips, etc.

Name change. Up to two months before the organization will charge 50 euros for this management, and until a month before the organization will charge 100 euros for this management. After this period, no name change will be allowed under any circumstances

Cancellation insurance. It is only contracted at the time of formalization of the registration and its contracting is optional. This insurance allows the return of 100% of the amount of the registration and contracted services in case of discharge up to two months before the test, and 50% up to one month before. After this period, no refund will be made under any circumstances, including suspension or modification of the course of the event due to adverse conditions or major force outside the organization.

Refunds. The registration fee will not be refunded under any circumstances, including suspension or modification of the course of the event due to adverse conditions or major force outside the organization. In no case will the event be postponed to another date. Participants who have contracted the cancellation insurance will be passed the inscription to following edition with the same options contracted.

Change of registration. The participant who wants to change their participation to the next edition will only be able to do so if they have contracted cancellation insurance, and it will be valid for that edition. If you wish to opt for a change or a refund to the next edition, the participant must take out the insurance again.

The inscription section will detail what it includes and what extras and additional services you can hire.

Medical certificate

The organization will request the participant a medical certificate that verifies the physical condition and the capacity to participate in the event. You will have to download and fill the following form,

  • The certificate must be filled by a qualified doctor for the purpose, with signature and collegiate number.
  • It will specify the tests that the doctor has estimated by age or risk have been performed.
  • The participant declares that all the information set forth in the medical certificate is true.

Participants

Open to all swimmers over 16 years old on December 31 of the year of the event.

Those under 18 must deliver the authorization of their guardians

It will be allowed to participate under 16 years prior authorization of their legal guardians and prior authorization of the Organization based on the course and their sports curriculum.

Each participant is responsible for his/hers physical condition before starting the swim race and agree to participate under his/her responsibility. In cases of illness and/or disability should be notified to the organization, reserving the right to allow their participation.

Doping is prohibited. With your registration, each swimmer accepts the doping rules, which are mandatory for the event. With their registration, each swimmer declares not to violate, before or during the event, the organic law 3/2013 of protection of the health of the athlete and fight against doping in the sport activity.

Participants should follow the instructions of competition officials and public authorities. Competition officials have the authority to disqualify any swimmer.

Each participant releases the organizers or any person or entity involved in the organization from liability

The route can be altered if recommends the weather conditions, getting the suspension of the event under final decision of the Safety Technical Committee

The organization is not responsible for loss of personal belongings of the participants. To avoid this, please do not leave valuables in bags of wardrobe.

Swimmers

Swimmers must demonstrate a maximum of 60' at 3000 meters in an official competition or have reached a similar challenge.

All the swimmers will receive a swim cap and a 6 tattoo set with the swimmer number is given to use during the race.

Wear a different swim cap will lead to disqualification.

Each swimmer must procure a kayaker that will follow from kayak meeting point. If the swimmer does not have, a kayaker should inform the organization in advance to hire it one by the participant.

All open-water swimwear must comply with World Aquatics' criteria regarding materials and approval procedures. No swimmer wearing swimwear not listed on World Aquatics' official registers will be permitted to participate. Exceptionally, and thanks to the open nature of the event, swimskins will be permitted subject to prior approval by the organization.

Wetsuits are not allowed under any circumstances.

In case of abandonment or health transport, the swimmer will be automatically disqualified and the organization informed.

Kayakers

The kayaker joins the race at meeting point and follows its swimmer outside the swimming path. When the swimmer needs something from the kayak it will get out the path to help this need.

The kayaker is not allowed to navigate in front of the swimmer, in this case it would be disqualified. The kayaker can navigate behind or beside.

The kayaker cannot interfere in the navigation of the other participants for of his swimmer, in this case he would be disqualified.

In case of abandonment or sanitary transport, the kayaker will be substituted from one arranged by the organization, and it will be the swimmer's decision to continue or abandon.

Competition

On the day before the race there will be a technical presentation where the participants will receive information and the mandatory use material. It is mandatory to assist.

The races will be under World Aquatics Open Water rules.

The races will be supervised by swimming officials.

Competition officials have the authority to disqualify any swimmer who does not follow the rules of the competition or violates the principles of fair play.

Timing with electronic chip

If a timing system with electronic chip is available, swimmer must wear it mandatory.

In case of abandon, the swimmer must return the chip to the organization.

In case of chip lost swimmer will be disqualified and must inform the judges and race direction, paying 10 euros for loss of chip.

Provisioning

Each swimmer must bring their own supplies to avoid incompatibilities between the usual consumed products and those provided by the organization.

The provisioning is done from the water without relying on any mobile point, reason why the swimmer can be disqualified.

The provisioning can also be done by foot on the ground or to a fixed point, but without taking any advantage advancing its position, which lead to its disqualification.

Swimmers will ask for supplies and will be supplied by baskets which will take the supplies.

Safety Measures

In the first level of safety there are kayaks, which develop the task of pilot, guide and feed the swimmers.

In the second level of safety you will find the motorboats, performing tasks of provisioning, monitoring, pilot, rescue, evacuation, opening and closing.

At a third level of security will find the ground teams, we can provide first aid care or transfer to a hospital.

We also have at our disposal the emergency teams in the area.

It will have a medical service to cater to any need for a participant.

Safety Technical Committee

The Safety Technical Committee is responsible in making decisions that affect the safety of the event, allowing it, making changes of route or ordering the suspension of it.

The Safety Technical Committee will evaluate weather conditions and security in the area at the time of the event, as well as the security measures that surround the event.

We define a general Celebration-Cancellation event protocol, flexible to the circumstances associated with time to carry out the event.

Event Celebration-Cancellation Protocol

The wind, the fog, the flow of the river and the water temperature are the 4 main climatic variables to consider.

Consider in a second term weather forecasts and their involvement in the course of the event.

It is over any decision of the Organization notices of Civil Protection and Emergency services.

Also consider safety and pilot partners. The factors, among others, are the number of kayaks, kayakers abilities, the number of boats and means of rescue and evacuation.

Obligation not to complete the race

The Organization reserves the right to force not to continue the test participants to ensure their safety.

Below are some cases in which members of the organization will end the adventure forcing participants to raise a support boat:

  • Worsening weather conditions or the state of the sea, river or reservoir which endanger the participants of the event.

  • Whenever a participant shows signs of extreme fatigue, dehydration, hypothermia, extremely slow pace or any other signs that impede normal swim.

  • Participants who do not follow the signs up the organization.

  • When the swimmer does the distress signal, raising one or both arms.

  • Do not reach the time cuts defined by the Technical Managing.

Competition officials and boat volunteers ensure the safety of swimmers and may compel any swimmer to leave the test to ensure their safety.

Insurance

The Organization will have a civil liability insurance policy and another of accidents, such as legislation, so that all participants will be covered.

Disclaimer of Liability and Declaration of Physical Fitness

Registration to the event implies the acceptance of the rules and the proper preparation of the participant for the event, and that is aware of the harshness of the weather conditions that can be found in the environment in which the test is disputed. In this sense, the participant exempts the organization of possible health problems derived from participation in the event.

Participants enrolled in the test understand that they participate voluntarily and under their own responsibility in the competition and therefore exonerate all responsibility for the organization of the test and agree not to denounce the organizing entity, collaborators, sponsors and other participants, as well as not initiate any claim of civil liability in the aforementioned parties. For these purposes, at the time of registration, the participant will have to mark the acceptance box of the discharge to formalize the registration.

The organization recommends all swimmers to make a 3000m pool test.

The organization does not recommend pointing to the test if the result of the 3000m pool test exceeds 60 minutes.

The organization recommends that all participants be given an annual medical check with effort test.
Recently, with the popularization of outdoor and long-distance sports, unfortunately, there are more and more deaths among participants. That's why the organization insists a lot on being careful.

Recall that the test insurance does not cover any pathology such as myocardial infarction.

Waiting lists

Once you have reached the limit of participants in an event, the organization will open a waiting list of participants who have been out of the event.

The organization resolved within no less than 72 hours before event participation or not participating in waiting under strict order of registration.

Purpose of processing

Data will be processed for the following purposes:

  • To manage registration and participation in the event.
  • To manage information arising from the race, including times, rankings, photographs and videos.
  • To compile aggregate participation statistics to improve the organization of future editions.
  • To send commercial communications about the activities, services and products of xswim project, its collaborating entities and the event's sponsors, provided the participant has given explicit consent.

Legal basis

Processing is based on the consent of the data subject (Art. 6(1)(a) GDPR), given when completing registration, as well as on the performance of the contract entailed by participation in the sporting event (Art. 6(1)(b) GDPR).

Retention period

Data will be kept for as long as the relationship with xswim project is maintained and, subsequently, for the periods legally required to address any potential liabilities.

Recipients

Data will not be disclosed to third parties, except where legally required or necessary to provide the service (collaborating entities and sponsors for promotional purposes, only with the participant's explicit consent).

Rights of data subjects

You may exercise, at any time, your rights of access, rectification, erasure (“right to be forgotten”), restriction of processing, data portability and objection, as well as withdraw any consent given — without affecting the lawfulness of processing carried out before such withdrawal — by sending an email to This email address is being protected from spambots. Minors

In accordance with Article 7 of the LOPDGDD, the processing of data relating to children under 14 years of age requires the consent of their parents or legal guardians, which must be given expressly at the time of registration.

Furthermore, in compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE), you are informed that the purpose of the website is to establish a channel of information, communication and services between xswim project and its users via the internet.

Authorisation for the use of images

In accordance with the right to one's own image recognised in Article 18.1 of the Spanish Constitution and regulated by Organic Law 1/1982, of 5 May, on the civil protection of the right to honour, personal and family privacy, and one's own image, xswim project requests the explicit consent of participants, or of their parents or legal guardians in the case of minors, to publish photographs or videos in which they are clearly identifiable.

By completing registration for the event, the participant (or their parent or legal guardian, in the case of a minor) expressly accepts that their image may appear in photographs or recordings made during activities organized by xswim project, for promotional or informational purposes, through:

  • Websites and social media.
  • Recordings intended for public broadcast.
  • Photographs for magazines or publications.
  • Digital presentations.
